Terms of Use

These Terms of Use ("Terms") govern your access to and use of the HEFTE website at hefte.au ("the Site") and any related services we provide. The Site is operated by Rockley Consulting Pty Ltd (ABN 78 673 819 773) trading as HEFTE ("we", "us", "our").

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Site.

1. The Site

The Site provides general information about EFTPOS providers operating in Australia and offers a comparison, calculator, and referral matching tool for hospitality and retail merchants.

The Site is provided as a self-serve information resource. It is not a financial product, financial service, or financial advice. We do not hold an Australian Financial Services Licence and we do not provide personal financial advice.

2. General information only

The information published on the Site is general information about EFTPOS arrangements in Australia. It does not take account of your particular business circumstances and is not financial, tax, legal, or professional advice. You should confirm current rates, terms, and features directly with the relevant provider, and seek professional advice tailored to your business before making any decision.

3. Referral arrangements

HEFTE has referral arrangements with the providers identified on our Disclosure page (currently Zeller, Zero Payments, H&L Pay, and urpay). When you submit a referral request through the Site and proceed with a matched partner, we may receive a referral commission from that partner. The existence of a referral arrangement does not affect the accuracy or balance of the information we publish about any provider, including non-partners.

By using the matching tools on the Site and submitting your details, you consent to your details being forwarded to the matched provider in accordance with our Privacy Policy.

4. Accuracy of information

We take reasonable care to keep the information on the Site current and accurate. Provider rates, terms, fees, hardware, and features change frequently, and the information on the Site is provided for general guidance only. We do not warrant that the information is current or free from errors. Always confirm current details directly with the provider before making a decision.

5. Acceptable use

You agree not to:

  • Use the Site for any unlawful or fraudulent purpose.
  • Use the Site to misrepresent yourself or another person or entity.
  • Submit a form on behalf of another person or business without authority.
  • Submit fraudulent, false, or speculative enquiries.
  • Use automated means (including bots, scrapers, or harvesters) to access the Site or its data, except for search-engine indexing.
  • Attempt to gain unauthorised access to the Site, its servers, or any related systems or networks.
  • Interfere with or disrupt the integrity or performance of the Site, including by transmitting any viruses, worms, or other malicious code.
  • Use the Site, or any content downloaded or copied from the Site, to construct a competing comparison or referral service.

6. Intellectual property

All content on the Site (including text, graphics, logos, design, layout, and code) is owned by Rockley Consulting Pty Ltd or its licensors and is protected by Australian and international copyright and other intellectual property laws.

Names, logos, and brand subtitles of third-party EFTPOS providers used on the Site (including Tyro, Zeller, Square, Stripe, Shift4, SumUp, ANZ, NAB, Westpac, St.George, Suncorp, CommBank, PayNuts, H&L Pay, Zero Payments, and urpay) are the trademarks or registered trademarks of their respective owners. They are used on the Site descriptively to identify each provider for the purposes of comparison and do not imply endorsement, sponsorship, or affiliation other than the referral arrangements expressly disclosed on the Disclosure page.

You may view, download, and print pages from the Site for your own internal business use, provided you keep all copyright and proprietary notices intact. You may not otherwise reproduce, republish, modify, distribute, or commercially exploit any part of the Site without our prior written consent.

7. Third-party links

The Site contains links to third-party websites, including the Zeller referral URL and the official websites of comparison providers. Those websites are operated by third parties and are not under our control. We are not responsible for the content of, or any transactions you enter into through, any third-party website. Following a link constitutes acceptance of the destination site's terms and privacy policy.

8. Disclaimer of warranties

To the maximum extent permitted by law, the Site is provided "as is" and "as available". We make no warranties or representations about the Site or its content, including that it is accurate, current, complete, reliable, fit for any particular purpose, or free from defects or interruption.

Nothing in these Terms excludes, restricts, or modifies any consumer right or guarantee provided under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot be excluded, restricted, or modified by agreement.

9. Limitation of liability

To the maximum extent permitted by law, and subject to section 8 above:

  • We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of revenue, loss of business, or loss of goodwill, arising from or in connection with your use of the Site or your reliance on any information on the Site.
  • Our total aggregate liability to you for all claims arising from or in connection with the Site (whether in contract, tort, statute, or otherwise) is limited, in respect of services we have provided to you, to the resupply of those services or the payment of the cost of having the services supplied again. Use of the Site is provided to you free of charge; we accept no other liability for it.

This section does not apply to liability that cannot be excluded or limited under applicable law, including under the Australian Consumer Law.

10. Indemnity

You agree to indemnify and hold harmless Rockley Consulting Pty Ltd, its directors, employees, contractors, and agents from any claim, loss, damage, cost, or expense (including reasonable legal costs) arising from your breach of these Terms, your misuse of the Site, or your infringement of any third-party right.

11. Variation

We may change these Terms from time to time. The version in force is the version published at hefte.au/terms with the most recent "Last updated" date. Material changes will be highlighted on the home page for a period of at least thirty (30) days. Your continued use of the Site after a change takes effect is your acceptance of the change.

12. Termination

We may suspend or terminate your access to the Site at any time, without notice, if we reasonably consider you have breached these Terms or are using the Site in a way that may cause harm to us, another user, or a third party.

13. Governing law and jurisdiction

These Terms are governed by the laws of Tasmania, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Tasmania and the courts entitled to hear appeals from them.

14. Severance

If any provision of these Terms is found to be unenforceable, that provision is severed to the extent necessary to make the remainder of these Terms enforceable, and the remainder continues in full effect.

15. Entire agreement

These Terms, together with the Privacy Policy and any other documents expressly incorporated by reference, constitute the entire agreement between you and us in relation to the Site and supersede any prior agreement or understanding.
